Announcement No. 137 of 2024 of the General Administration of Customs (Announcement on Matters Related to Launching the Pilot Business Model of Railway Public Multimodal Transport for Exported Goods)

In order to support the high-quality development of multimodal transport, adapt to the adjustment and optimization of modern logistics and transportation structure, and improve the level of facilitation of customs clearance of international multimodal transport goods, according to the the People's Republic of China Customs Law and the measures of the People's Republic of China Customs on the Supervision of goods in transit (issued by decree No. 89 of the General Administration of Customs and amended by decree No. 240 of the General Administration of Customs, hereinafter referred to as the measures for the Supervision of goods in transit), the General Administration of Customs, the General Administration of Customs has decided to launch of Customs, the relevant matters are hereby announced as follows:

1. enterprises may, according to their own needs, carry out the multimodal transport business of export goods mentioned in this announcement, and the relevant business model pilot shall meet the following requirements:

(I) carried goods shall be containerized.

The mode of transport within the territory of the (II) is limited to railway transport, or railway transport plus road transport.

(III) outbound transport mode shall be road transport.

The scope of goods carried by the 2. shall comply with the requirements of the Measures for the Supervision of Goods in Transit between Customs Offices and relevant announcements.

Containers 3. to carry goods shall comply with the relevant requirements of the the People's Republic of China Customs Measures for the Supervision of Containers and Container Trucks Used to Load Goods under Customs Supervision (Order No. 110 of the General Administration of Customs, as amended by Order No. 198, 240 and 262 of the General Administration of Customs).

Domestic road transport vehicles carrying goods shall comply with the relevant requirements of the the People's Republic of China Customs Measures on the Administration of Domestic Road Carriers of Goods under Customs Supervision and Their Vehicles (Order No. 88 of the General Administration of Customs, as amended by Order No. 121, 227, 235, 240 and 262 of the General Administration of Customs).

Multimodal transport operators (hereinafter referred to as intermodal transport operators) and customs-supervised workplace operating enterprises (hereinafter referred to as venue operating enterprises) that 4. adopt the above-mentioned railway-public multimodal transport model to submit multimodal electronic data to the Customs through the "single window" of international trade.

5. operation process:

The (I) intermodal transport operator shall apply to the Customs for the data transmission of the multimodal transport business on the basis of the Application Form for Data Transmission of the Multimodal Transport Business of Export Goods. Before the goods go through the customs export declaration procedures, the intermodal operator shall submit to the customs an application form for multimodal transport.

Enterprises operating (II) premises shall apply to the Customs for the data transmission of multimodal transport with the Application Form for Data Transmission of Multimodal Transport of Export Goods. When the goods arrive at the customs-supervised workplace at the place of departure, the business enterprise of the place transmits the arrival information to the customs.

After the (III) receives the release information of the multimodal transport application form, the place operating enterprise may handle the loading and departure procedures and transmit the departure information to the customs.

After the (IV) goods arrive at the place of replacement, the place operating enterprise transmits the arrival information to the customs before the replacement operation can be carried out.

After the replacement of (V) goods is completed, the place operating enterprise shall transmit the departure information to the customs.

After the (VI) goods arrive at the place of exit, the premises operating enterprise shall transmit the arrival information to the customs.

(VII) outbound transport logistics information such as outbound means of transport needs to be supplemented, the intermodal operator needs to supplement the transmission of outbound logistics information before the goods leave the country.

"Application Form for Data Transmission of Multimodal Transport of Export Goods", "Data Item of Application Form for Multimodal Transport of Export Goods", "Data Item of Arrival Information", "Data Item of Departure Information", "Supplementary Data Item of Outbound Logistics Information", "Data Item of Change of Domestic Logistics Information", "Application Form for Multimodal Transport of Export Goods and Related Electronic Data Filling Specifications" are detailed in the annex.

Change and deletion of 6. information:

If the (I) changes the data transmission application information, the intermodal operator or the place operating enterprise shall go through the change procedures with the customs where the data transmission application is accepted. If the multimodal transport business has not been completed, the application for data transmission shall not be canceled.

If the (II) changes or deletes the multimodal transport application form or domestic logistics information, the intermodal transport operator may apply to the customs at the place of departure.

If the (III) arrival information and departure information are incorrect, the intermodal operator or the place operating enterprise may apply to the customs where the arrival or departure is located for deletion and resubmission.

If the (IV) intermodal transport operator needs to change the outbound means of transport and other logistics information, it shall apply to the customs at the place of departure to change the outbound logistics information.

If the (V) multimodal transport application form does not match the corresponding arrival information or departure information, the customs shall notify the intermodal operator or the place operating enterprise by electronic data. After receiving the notice, the intermodal operator or the place operating enterprise shall promptly explain the situation to the customs where the goods are located, and handle the electronic data change procedures with the customs according to the actual situation.

If the 7. leaves the place of departure or the place of change of customs supervision by road transport, the business enterprise of the place shall transmit the departure information to the customs before the means of transport leaves the site.

If the transport services within the 8. are provided by the same intermodal transport operator and railway transport is involved in the reloading, with the consent of the Customs, they may be carried out in non-customs-supervised workplaces, and the intermodal transport operator shall transmit the departure and arrival information, and the Customs may send personnel to supervise the reloading means of transport, and if necessary, the goods may be checked.

9. seals shall be imposed during the multimodal transport of goods, and the intermodal operator shall keep the seals intact during the intermodal transport. Without the consent of the Customs, the seals imposed by the Customs shall not be opened or damaged.

If the joint transport of multimodal goods involves domestic road transport, the customs seal shall be imposed by the customs at the place of departure; if it is not determined that road transport is involved in the territory at the time of departure but the means of road transport need to be replaced due to logistics, the customs seal shall be imposed by the customs at the place of operation under the supervision of the customs. When multimodal goods are carried by railway trains, the customs seal may not be imposed if the commercial seal is intact.

The customs at the place of departure is 10. responsible for the supervision of multimodal transport goods en route. If it is necessary to change boxes, seals or road transport vehicles during transportation due to traffic accidents and other reasons, the intermodal operator or the person in charge of the transport vehicle shall notify the customs at the place of departure and go through the procedures for changing boxes and seals under the supervision of the customs.

11. If the goods are canceled for export, they may apply to the customs at the place of departure for the termination of multimodal transport in accordance with the following procedures:

(I) the consignor of the exported goods or his agent for the cancellation of the customs declaration.

The (II) intermodal transport operator shall complete the multimodal transport application form.

XII. When filling in the "the People's Republic of China Customs Export Goods Declaration Form" for Tiegong multimodal transport goods, the "mode of transport" column shall be filled in as "road transport (code 3)" according to the actual mode of transport of the goods leaving the country; The "name of the means of transport" in the "name of the means of transport and voyage number" column fill in the "multimodal transport application number", and the "voyage number" is exempted from filling; in the column of "waybill number", fill in the "multimodal transport waybill number". For other outbound goods filled in as "road transport (code 3)" in the column of "mode of transport", the requirements for filling in the columns of "name and voyage number of means of transport" and "waybill number" remain unchanged.

When transmitting the outbound road pre-distribution manifest, the "Customs Cargo Clearance Code" data item should be filled in with "RD15 Export Packing".

13. The meanings of the following terms in this announcement are:

The place of departure refers to the place where the multimodal export goods are declared and shipped.

The place of exit refers to the last domestic port before the multimodal export goods leave the opening and closing border.

The place of change refers to the place where the multimodal transport goods are loaded, unloaded and changed into the means of transport within the territory.

Arrival information refers to the information that reflects the actual arrival of multimodal transport goods at the customs supervision workplace or the place recognized by the customs.

Departure information refers to information reflecting the departure of multimodal transport goods from the place of departure or replacement.

This announcement will be implemented from October 15, 2024.
