The announcement stated that, pursuant to the Presidential Executive Order just signed by U.S. President Trump—“Imposing a Temporary Additional Import Duty Under Section 122 of the Trade Act of 1974 to Address Balance-of-Payments Issues”— Starting from midnight on February 24, an additional temporary “Section 122 tariff” of 10% will be imposed for a period of 150 days, with the validity period ending on July 24, 2026.

U.S. Customs and Border Protection CBP

In its notice, U.S. Customs and Border Protection (CBP) also announced the conditions for certain tariff exemptions, as detailed below:

Goods that have been loaded onto the vessel before midnight on February 24 (Eastern Time) and cleared for release before midnight on February 28 are exempt from this 10% tariff.

Product Exemptions: The previously imposed Section 301 tariffs remain unaffected. Goods already subject to the “232 tariff” (such as steel and aluminum, passenger vehicles and their parts, semiconductors, lumber, certain copper products, etc.) will not be subject to this additional 10% tariff.

After Trump returned to the White House, he launched a frenzied campaign of raising tariffs. On April 9 last year, the tariff rate on China reached as high as 145%. Following the summit between Chinese and U.S. leaders in Busan at the end of October, the rate was reduced to about 45%, an increase of 25 percentage points compared to the level before Trump came into power.

In its recent ruling, the U.S. Federal Court of Appeals has reverted the Trump administration’s tariffs on China to the status they were at before “Liberation Day.” According to the aforementioned notice from U.S. Customs and Border Protection (CBP), the newly imposed tariff rates will be reduced to 10%. Compared to the previous 20% additional tariffs imposed on China (10% in equivalent tariffs plus 10% in fentanyl tariffs—both referring to the actual tax rates during the tariff deferral period), the tariff rate has been cut in half, effectively halved.

Even factoring in the tariffs left over from Trump’s previous term, the total tariffs imposed on China still amount to only 30%, which is lower than the roughly 45% seen after last year’s Busan meeting—and even further below the peak of 145% reached last year.
