Ministry of Commerce: Imposes anti-dumping duties on the United States and South Korea, with rates as high as 113.8% for a period of five years.

According to the latest information: Yesterday (January 13), in the afternoon, China’s Ministry of Commerce issued Notice No. 3 of 2026. Announcement, effective from 202 Starting January 14, a five-year anti-dumping duty will continue to be imposed on imported solar-grade polysilicon originating from the United States and South Korea.

The announcement also stated: The Ministry of Commerce ruled that if the anti-dumping measures are terminated, Dumping of imported solar-grade polysilicon originating from the United States and South Korea into China may continue or reoccur, and the damage inflicted on China’s solar-grade polysilicon industry may also continue or reoccur.
 



 

The announcement stated that a final review has been conducted on the anti-dumping measures applicable to solar-grade polysilicon imported from the United States and South Korea.

On January 20, 2014, the Ministry of Commerce announced its decision to impose anti-dumping duties on imports of solar-grade polysilicon from the United States and South Korea, effective immediately. The tariff rates for U.S. companies range from 53.3% to 57%, while those for South Korean companies range from 2.4% to 48.7%. The duration of the measure is five years.

On November 21, 2017, the Ministry of Commerce announced its decision to adjust the anti-dumping tax rates on polysilicon for solar-grade imported from South Korea to a range between 4.4% and 113.8%. On January 19, 2020, the Ministry of Commerce announced that, effective January 20, 2020, it would continue to impose anti-dumping duties on polysilicon for solar-grade imported from the United States and South Korea at the rates specified in the Ministry’s 2014 and 2017 announcements, with an implementation period of five years.

On May 29, 2020, the Ministry of Commerce issued an announcement deciding that Hanwha Solutions Corporation would succeed Hanwha Chemical Corporation in regard to the tariff rates and other rights and obligations applicable under the anti-dumping measures on solar-grade polysilicon.

On January 10, 2025, in response to an application from China’s solar-grade polysilicon industry, the Ministry of Commerce announced that, effective January 14, 2025, it would initiate a sunset review investigation into the anti-dumping measures applicable to imports of solar-grade polysilicon from the United States and South Korea.

The Ministry of Commerce ruled that if the anti-dumping measures are terminated, dumping of solar-grade polysilicon imported from the United States and South Korea into China could continue or reoccur, and the damage inflicted on China’s solar-grade polysilicon industry could also continue or reoccur.

In accordance with the relevant provisions of the Anti-Dumping Regulations, the Ministry of Commerce has submitted a recommendation to the Tariff Commission of the State Council based on the investigation results, proposing the continuation of anti-dumping measures. Based on the Ministry of Commerce’s recommendation, the Tariff Commission of the State Council decided that, effective January 14, 2026, anti-dumping duties will continue to be imposed on solar-grade polysilicon imported from the United States and South Korea for a period of five years, with the duty rates remaining unchanged.

This product is classified under the “Customs Tariff of the People’s Republic of China” as: 28046190. Electronic-grade polysilicon used in the production of semiconductor devices such as integrated circuits and discrete components, which falls under this tariff heading, is not within the scope of the products subject to this investigation.
