How to charge for shipping delay?

(1) According to the relevant provisions of the Customs Law, the consignee or his agent of imported goods shall claim the name in the means of transport

Declare to the customs within 14 days from the date of entry, the customs will charge a certain amount of overdue fees according to law.

(2) Starting date of overdue payment for imported goods by sea, air or land shall commence on the 15th day from the date on which the means of transport are declared to enter China; The shipment of imported goods by mail shall commence on the 15th day after the recipient receives the notice from the post office; The transit of goods shall commence on the 15th day from the date on which the means of transport is declared to enter the territory and on the 15th day from the date on which the goods arrive at the place of transport. If the 15th day falls on a Saturday, day or statutory holiday, the calculation will be postponed.

(3) The late declaration fee shall be charged on a daily basis, including the date on which the consignee or his agent declares to the customs. The daily amount of the overdue fee is 0.05% of the CIF price of imported goods, and the threshold of the overdue fee is 10 yuan. The overdue fee shall be charged in yuan, and the part less than RMB l yuan shall be exempted

 

Measures of the Customs of the People's Republic of China for collecting fees for late declaration of imported goods

Article 1 These Measures are formulated in accordance with Article 18 of the Customs Law of the People's Republic of China for the purpose of strengthening the supervision and administration of imported goods, speeding up port distribution and promoting the early use of imported goods.

Article 2 For imported goods, if the consignee or his agent (hereinafter referred to as the consignee) fails to declare and complete the import formalities with the Customs within 14 days from the date when the means of transport is declared to enter the territory, the Customs shall levy a fee for delay in reporting according to the provisions of these Measures.

Article 3 The starting date of levying fees for delay shall be the 15th day from the date on which the means of transport declare entry into China; The effective date for late declaration of imported goods by mail shall be the 15th day after the addressee receives the notice from the post office.

The starting date of collection of overdue payment for transit transport goods shall be the 15th day from the date of declaration of the means of transport and the 15th day from the date of arrival of the goods at the place of transport, and shall be levied by the customs at the place of entry and the customs at the place of transport respectively.

The delay fee shall be charged on a daily basis. The date of declaration by the consignee to customs is also counted.

If the 14th day of the date on which the means of transport declares entry (the recipient receives the notice from the post office and the goods are delivered to the place of transport) is a statutory holiday, the calculation shall be postponed accordingly.

Article 4 THE DAILY AMOUNT OF OVERDUE PAYMENT SHALL BE 0.5% of the CIF price of the imported goods. The threshold for late reporting is 10 yuan.

The CIF price of imported goods refers to the normal CIF price approved by the customs. If the CIF price cannot be determined, it will be assessed by the customs.

Where the CIF price of imported goods is denominated in foreign currency, the customs shall convert the CIF price into RMB according to the central trading rate of the RMB Foreign Exchange Quotation Table published by the State Administration of Foreign Exchange on the date when the receipt for the collection of overdue fees is issued. Foreign currencies without quoted prices shall be converted and calculated at the exchange rate determined by the State Administration of Foreign Exchange.

Article 5 The CUSTOMS SHALL issue a receipt to the consignee of the imported goods after collecting the FEE for late declaration.

The amount of delayed payment shall be calculated in YUAN, and the part less than RMB 1 yuan shall be exempted.

Article 6 The Customs shall not release the imported goods for which the overdue declaration fee has been levied until the overdue declaration fee has been paid.

Article 7 If the consignee of imported goods or his agent really fails to declare at the customs within the prescribed time limit due to special circumstances, after submitting an application to the customs and providing a definite certificate, which has been examined and approved by the Customs, he may not be punished for delay in declaration or be charged for delay in declaration.

Article 8 The late reporting fee may be exempted under any of the following circumstances:

(1) the consignees have failed to declare to the customs within three months from the date of the declaration of entry of the means of transport, and the Customs has taken out the goods for sale and disposed of them in accordance with Article 21 of the Customs Law of the People's Republic of China;

(2) The consignee, with the approval of the customs, provides a guarantee to the customs, takes delivery of the goods first and completes the declaration formalities within the period of the guarantee;

(3) For imported goods detained by the customs, no fee for delay in reporting shall be levied during the period of detention;

(4) The fee for delayed reporting is less than RMB 10 yuan.

Article 9 These Measures shall be implemented as of August 1, 1987.
